AnywhereDolphin Privacy Notice

Dolphin Imaging and Management Solutions recognizes the importance of your privacy. We believe that protecting and securing private information is an issue of trust and we strive to manage and protect the personal information you provide to us in a fair and respectful manner. This privacy notice describes how we treat all user data including Personal Information which is collected by us during your visit to our Site (both terms as defined below). By opening an account (as a Subscriber or Referral) or by using the Site (as a Subscriber, Referral or Patient), you agree to have the collection and use of your information governed in accordance with the terms of this privacy notice. We may change this privacy notice from time to time as described below.

If you are a Referral or a Patient please note that we operate the Site to provide the Service to our Subscribers and we process your Personal Information for and on their behalf and on their instructions for that purpose. We do not control the Personal Information in records about Patient’s which are uploaded to the Site and processed by us for the Service. Subscribers and Referrals have obligations under their locally applicable data privacy laws for the processing of Personal Information we carry out for them pursuant to the Service. They may have their own privacy notices which provide further information about their own privacy practices and we do not control those privacy notices.

I. Definitions

"Dolphin", "We" or "us" means Patterson Dental Supply, Inc., d/b/a Dolphin Imaging and Management Solutions, and its affiliated companies.

"Non-Personal Information" means any information that is not Personal Information.

"Patient" means an individual waiting for or under the care of a Subscriber.

"Personal Information" is information that relates to an individual who is or can be identified from that information either by itself or when it is combined with other data or information. It includes information which may be used to identify, transact with or contact an individual, such as name, street address, email address, or payment information. It includes information about physical health and conditions (including in relation to Patients).

"Referral" means a dental or other health care professional to whom a Subscriber shares Patient records for purposes such as consultation or referring a Patient for dental or other health care services.

"Service" means the AnywhereDolphin subscription-based service that allows Subscribers to share Patient records and communicate with Referrals and Patients and which is made available on the Site.

"Site" means the AnywhereDolphin website and associated webpages located at www.AnywhereDolphin.com

"Subscriber" means a dental professional, clinic or laboratory that has a license to use Dolphin® Imaging software and a valid subscription to the Service,

"You" means a user of the Site. As a user, You must be a Subscriber, a Referral or a Patient.

II. Introduction

The Service is only available on the Site to registered users. Subscribers may use the Service and the Site to upload Patient records. Subscribers, Patients and Referrals may use the Service to view the Patient records from supported web browsers and to communicate with one another about such records. Ancillary services available as part of the Service, if enabled by the Subscriber, include allowing Patients the ability to schedule appointments, provide medical histories and other documents, and make certain types of payments to their Subscriber.

III. Information We Collect and How We Use It

A. Types of Information

In providing the Service, Dolphin collects two types of information from You:

  • Personal Information. We collect your Personal Information that You provide to us. Subscribers, Referrals and Patients provide Personal Information about themselves when they register or use the Service; Subscribers provide information, including personal health records, about Patients when Subscribers use the Service to upload and share Patient records; and Patients provide information such as payment information when they use the Service. This includes information about physical health and conditions (including in relation to Patients).
  • Non-Personal Information. We also automatically collect information that You provide to us that does not constitute Personal Information. Non-Personal Information does not and cannot be used alongside other information to identify You. Instead it identifies, for example, the machine or other device used by You to access the Site. It may be collected through “cookies”, such as information related to how You use the Site. Non-Personal Information also includes anonymous or aggregated data.

B. The Type of Personal Information We Collect Will Depend on Whether You are a Subscriber, a Referral or a Patient

Subscribers
To use the Service, a Subscriber must register on the Site and open an account with Dolphin. The first time You (meaning, for the purposes of this section, the Subscriber) use the Service, the Site will request the information required to open an account, which may include Personal Information such as name and email address, payment information, street address and phone number(s), and professional information, such as area of specialization. You will also be required to select a username and password.
Before uploading a Patient's record(s) to the Site, You must obtain from the Patient, and You warrant and represent to us that You have obtained from the Patient, all required consents including explicit consents as relevant and relating to the Personal Information. This includes consents for the transfers of the Personal Information outside local countries to us in the United States and consents including explicit consents for the Personal Information to be processed for the purposes of the Subscriber’s use of the Service and the Site (in each case as relevant pursuant to applicable data privacy law). You acknowledge that obtaining all such consents is Your responsibility under applicable data privacy law on the basis you are controlling the Personal Information processed by us for the Service. Further details on transfers is at Section VIII (below).
Referrals
To access Patient records on the Site, You must register on the Site and open an account with Dolphin. If You have previously registered as a Subscriber, You need not register again as a Referral. The first time You use the Service, the Site will request the information required to register, which may include Personal Information such as your name and email address and professional information, such as area of specialization. You will also be required to select a username and password.
Patients
As a Patient, in order to access the Site, your Subscriber must first supply us with your email address. The Service will then automatically create an account for You, and email You a link, username and password to complete your access to the Site. When You log onto the Site, You may change your password.

Dolphin relies on the Subscriber to obtain from each Patient any and all consents including explicit consents that may be required by any applicable law, rule or regulation, including applicable data privacy law, or that may be otherwise required pursuant to any contract or agreement relating for the Subscriber's use of the Service and the Site.

If You are a Patient, by accessing the Site and using the Service, You agree that You have consented, including by means of giving your explicit consent, to the Subscriber's use of the Service and Site including your health records and information. This includes consent for the transfers of the Personal Information outside local countries to us in the United States and consents for the Personal Information to be processed for the purposes of the Subscriber’s use of the Service and the Site (in each case as relevant pursuant to applicable data privacy law). Further details on transfers of such Personal Information are described in Section VIII.

C. How We Use the Personal Information We Collect Will Depend on Whether You are a Subscriber, Referral or Patient

Subscribers
Use and Operation of Service. We use your Personal Information for purposes of providing and operating the Service. These purposes include allowing You to upload and view Patient records, make Patient records accessible to the Patients and the Referrals, and communicate with your Patients and Referrals about the records. Such use of your Personal Information may also include communicating with You in response to your requests for additional services or to address technical support, billing and other Service management issues.
Newsletters. Subject to your prior consent if required by applicable law, we may also use your Personal Information (specifically your email address) to send You secondary communications such as newsletters or marketing information about our products or services. You may opt-out of such communications by following the instructions in the communications received by You.
Surveys. From time to time We may provide You the opportunity to participate in surveys on the Site. If You participate, We will request certain Personal Information (such as demographic information, e-mail, phone, and/or address) from You. Participation in surveys is completely voluntary and You, therefore, have a choice whether or not to disclose this additional Personal Information to us. We use the Personal Information and Non-Personal Information gathered in surveys to improve the ease-of-use of our Site, otherwise improve the Site or the Service, or obtain feedback on changes or improvements We have made.
Referrals
Use and Operation of Service. We use your Personal Information for purposes of providing and operating the Service. These purposes include allowing You to access Patient records and communicate with the Patient and the Subscriber who made the records available to You. Such use of your Personal Information may also include communicating with You in response to your requests for additional services and to address technical support issues.

Patients
Use and Operation of Service. We use your Personal Information for purposes of providing and operating the Service. These purposes include allowing You to access your records uploaded to the Site by your Subscriber and to communicate with your Subscriber and Referrals about your records. Your Subscriber determines what records are uploaded to the Site and what access the Referrals may have. If You choose, We may also use certain of your Personal Information (such as payment card information) to make online payments for the services rendered by your Subscriber. We may use certain of your Personal Information to communicate with You in response to your requests for services or to address technical support issues, but ordinarily We communicate directly with your Subscriber, who will handle communications with You.

D. Anonymous Data and Data aggregation

We may anonymize or aggregate Personal Information so that individuals are not identified or identifiable from it, in order to use it for additional purposes. We may use such anonymized or aggregated data, for example, for statistical analysis and administration including analysis of trends, to carry out actuarial work, to tailor products and services, and to conduct risk assessment and analysis of costs and charges in relation to our products and product support services. We may also share such anonymized or aggregated data within our group of companies and with our partners and other third parties.

E. How We Use the Non-Personal Information We Collect

Log Files. We automatically record certain Non-Personal Information that your browser sends to us whenever You visit the Site. We store this information as log files. These log files may include Non-Personal Information such as the content of your query, internet protocol (IP) address, browser type, browser language, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We use the Non-Personal Information in the log files, as well as some potential Personal Information (such as usernames), to analyze trends, administer the Site, track a users' movements around the Site and gather and aggregate demographic information. We do not link this automatically-collected Non-Personal Information to other Personal Information.

Cookies and Site Statistics. A cookie is a small text file that is stored on a user's computer for record-keeping purposes. Cookies contain information that can later be read by a web server in the domain that issued the cookie to You. We use cookies on the Site; however, We do not link the Non-Personal Information stored in cookies to any Personal Information You submit while on our Site. You may decline the cookies, but some functionality of the Site may be lost if You do so. You may also delete them at any time by changing your browser settings.

F. Changing or Deleting Certain Information

By logging on to the Site’s registration page, Subscribers and Referrals may change the details surrounding their Personal Information. You agree you will do this promptly if your Personal Information, such as your contact details, become out of date. Subscribers may also change the terms surrounding their Service subscription. Subscribers control their Patient’s records that are uploaded to the Site and may remove or delete these records. Although any Personal Information that is changed, removed or deleted from the Site is no longer available on the Site, such information may remain stored in our back-up and archival records for as long as is required or otherwise permitted under applicable laws including privacy laws.

IV. Information Sharing and Disclosure of Personal Information to Third Parties

We do not sell or rent your Personal Information to third parties (except for sales in a Business Transfer scenario as mentioned below). We may disclose your Personal Information under the following circumstances:

A. Service Providers

We may disclose or otherwise make your Personal Information available to service providers that help with our business operations (including those inside and outside our group of companies). Such Personal Information may be stored and processed by our service providers in the United States or other locations where they maintain facilities (including those outside your own country). We instruct our service providers to keep your Personal Information secure, and not to use or disclose such Personal Information for any purpose other than providing the services We obtain from them on our behalf.

B. Legal Requirements and Protection of Our Company and Others

We may need to disclose your Personal Information and/or Non-Personal Information when required by applicable law, rules or regulations, including through legal processes such as subpoenas or court orders. We may also disclose such information when We have a good faith belief that disclosure is otherwise necessary or appropriate. Examples of circumstances that may lead to disclosure are:

  • To investigate, prevent or take action regarding suspected or actual illegal activities or other wrongdoing or to assist government or law enforcement agencies;
  • To enforce this privacy policy, investigate and defend our company against third-party claims or allegations, or protect the security or integrity of the Site;
  • To exercise or protect our rights, property or personal safety, including the rights, property or personal safety of our users, employees, agents or others; and
  • To establish or exercise our legal rights, to defend legal claims, or as otherwise required or permitted by applicable laws and/or regulations. If you are a Patient or a Referral, we may also disclose your Personal and/or Non-Personal Information with the Subscriber as necessary to perform the Service.

C. Business Transfers

We may also disclose your Personal Information and/or Non-Personal Information to a third party as part of liquidation, reorganization, merger, or sale of our assets or those of our affiliates or divisions, or any other similar "change of control". Any third party to which We transfer or sell our assets will have the right to continue to use the Personal Information and Non-Personal Information that You provide to us.

D. Links to Other Sites

If the Site contains links to other web sites that are not owned or controlled by us, please be aware that We are not responsible for the privacy practices of such web sites. We encourage You to be aware when You leave the Site and to read the privacy notices and/or statements of each and every other web site that collects your Personal Information. This privacy notice applies only to Personal Information and Non-Personal Information collected by or on the Site.

V. Security

Securing your Personal Information is important to us. We take physical, electronic and administrative steps to prevent the unauthorized release of or access to your Personal Information. For example:

  • When a user registers with us, logs on to the Site to upload Patient records or to access Patient records, or otherwise communicates with us through our servers, the transmissions are encrypted using Secure Socket Layer (SSL) protocol.
  • A user’s access to the Site is controlled by a username and a password.
  • Our employees are instructed to access and use only Personal Information they need to perform their job duties.

No method of transmission over the Internet, or method of electronic storage, is completely secure. Consequently, while We strive to use commercially reasonable means to protect your Personal Information, We cannot guarantee its absolute security. Any user of our Site is responsible for maintaining the confidentiality of their passwords. Subscribers and Referrals are responsible for limiting access to the Site to their appropriate personnel. If You are sharing a computer with anyone, You should always log out of our Site before You leave the Site. You must never share your username or password with any other person. It is also important for You to understand that e-mail communication, including the e-mail functionality on the Site, is not a completely secure and confidential means of communication. Please do not communicate with us through the Site, or otherwise use the Site, unless you accept the security implications of dealing online. Information you send through the Site is sent at your own risk.

VI. Children and Minors

All use of the Site in any way relating to a minor or a child under the age of 13 is restricted to such individual’s authorized legal guardian. We do not knowingly permit minors and children under the age of 13, to use the Site. While the Site may contain Personal Information (specifically, Patient records) about such individuals, the Site is not designed for use by them.

VII. Changes to this Privacy Notice

We reserve the right to modify this privacy notice and our privacy policies at any time by posting a revised notice on the Site. We may also choose to notify You by other means, such as email. We encourage You to review the notice frequently. You can tell by the "last updated" date indicated below when the notice was most recently modified.

VIII. Users Located Outside the United States

Information provided to us from outside the United States will be stored in our systems located in the United States. If You are located outside the United States, You consent to this transfer and You acknowledge that this privacy notice and our privacy practices and policies with respect to any use we make of your Personal Information for compliance with our own legal and regulatory obligations (including those mentioned above) are governed by applicable U.S. federal and state law, regulations and rules. This use is distinct from our processing of Personal Information for and on behalf of the Subscriber to provide the Service. The Subscriber is controlling the processing of Personal Information we carry out for it pursuant to the Service and it has obligations under its locally applicable data privacy laws for that. You may have rights under locally applicable data privacy laws which are enforceable against the Subscriber.
